ইসলামে তালাকপ্রাপ্ত নারী খোরপোষ পায় না

ভূমিকা

তালাক-পরবর্তী খোরপোষ (maintenance) ও আবাসন (lodging)–এর প্রশ্নটি ইসলামি আইনশাস্ত্রে শুধুমাত্র একটি পারিবারিক বিধান নয়; এটি ক্ষমতার অসম সম্পর্ক, নারীর অর্থনৈতিক নির্ভরশীলতা এবং গৃহস্থালি শ্রমের সামাজিক অবমূল্যায়নের সাথে গভীরভাবে জড়িত। বিশেষ করে “বায়িন” বা অপরিবর্তনীয় তালাকের (যেমন তিন তালাক বা রুজুর সুযোগহীন তালাক) ক্ষেত্রে প্রভাবশালী শরীয়ত ব্যাখ্যাগুলো তালাকপ্রাপ্ত নারীর আবাসন ও খোরপোষ উভয়ই সম্পূর্ণভাবে নাকচ করে দেয়। ফাতিমাহ বিনতে কায়সের সূত্রে বর্ণিত সহিহ হাদিসে (সহিহ বুখারী ৫৩২৩-৫৩২৪; সহিহ মুসলিম ৩৬০০) মুহাম্মদের সরাসরি বক্তব্য পাওয়া যায় যে, অপরিবর্তনীয় তালাকপ্রাপ্ত নারীর জন্য বাসস্থান বা খোরপোষ কোনোটাই প্রাপ্য নয়। উল্লেখ্য, ইসলামি শরিয়তে তালাক দেয়ার ক্ষমতা শুধুমাত্র স্বামীর হ্যাটেই ন্যস্ত করা হয়েছে (( ইসলামি শরিয়তে তালাক দেয়ার অধিকার একমাত্র স্বামীর ))।

এই প্রবন্ধে তিনটি স্তরে বিশ্লেষণ উপস্থাপন করা হয়েছে: (১) উৎস-টেক্সটগুলোর (কুরআন ও হাদিস) মধ্যে বিদ্যমান টানাপোড়েন এবং সম্ভাব্য সমন্বয়ের চেষ্টা, (২) ক্লাসিক্যাল ফিকহের মধ্যে অবস্থানগত বিভাজন, এবং (৩) আধুনিক নীতিশাস্ত্র ও তুলনামূলক আইনি যুক্তির আলোকে এই বিধানের সামাজিক-অর্থনৈতিক প্রভাবের মূল্যায়ন।


পরিভাষা ও বিশ্লেষণ-পদ্ধতি

রেভোকেবল বনাম ইররেভোকেবল তালাক: ইসলামি ফিকহে রেভোকেবল (রাজ‘ঈ) তালাক বলতে এমন তালাক বোঝায় যাতে ইদ্দতকালীন সময়ে স্বামীর রুজু (পুনর্বিবাহ ছাড়াই ফিরে আসা) করার সুযোগ থাকে। অন্যদিকে, ইররেভোকেবল (বায়িন বা তালাক-ই-মুগাল্লাযা) তালাকে এই রুজুর সুযোগ সম্পূর্ণভাবে বন্ধ হয়ে যায়। অনেক ফকিহ ইদ্দতকালীন ভরণপোষণকে বৈবাহিক সম্পর্কের অবশিষ্ট প্রভাবের অংশ হিসেবে বিবেচনা করেন, কিন্তু ইররেভোকেবল তালাকের ক্ষেত্রে এই ভরণপোষণের অধিকারও পুরোপুরি নাকচ করে দেওয়া হয়—এটিই প্রভাবশালী মত।

বিশ্লেষণ-পদ্ধতি: এই প্রবন্ধে তিনটি স্তরে বিশ্লেষণ করা হয়েছে: (ক) টেক্সচুয়াল রিডিং—কুরআনের তালাক-সংক্রান্ত আয়াতসমূহ এবং ফাতিমাহ বিনতে কায়স-সংক্রান্ত হাদিসগুলোর সরাসরি বক্তব্যের সমালোচনামূলক পাঠ; (খ) ফিকহি ম্যাপিং—বিভিন্ন ইমাম ও মাযহাবের মধ্যে আবাসন ও খোরপোষ বিষয়ে অবস্থানের তুলনামূলক মানচিত্র; (গ) নর্মেটিভ এনালাইসিস—ন্যায়বিচার, ক্ষতিপূরণের যৌক্তিকতা এবং সামাজিক নিরাপত্তার বাস্তব মানদণ্ডে এই বিধানগুলোর প্রভাবের মূল্যায়ন।


কোরআনঃ “বাড়ি থেকে বের করে দিও না” এবং “ব্যবস্থা/মাতাআ”

কোরআনের সূরা আত-তালাক (৬৫)-এর শুরুতেই (৬৫:১) একটি স্পষ্ট নির্দেশ আছে: তালাকের পর ইদ্দতকালীন সময়ে নারীদের “তাদের ঘর থেকে বের করে দিও না” এবং তারাও যেন স্বেচ্ছায় না বের হয়। এই নির্দেশ অন্তত ইদ্দতকালীন আবাসনের অধিকারকে নীতিগতভাবে স্বীকৃতি দেয়। একই সূরার ৬ নম্বর আয়াতে (৬৫:৬) আরও বলা হয়েছে: “তোমাদের সামর্থ্য অনুযায়ী তাদের বাসস্থান দাও… যদি তারা গর্ভবতী হয় তবে সন্তান প্রসব পর্যন্ত তাদের ব্যয়ভার বহন করো… এবং যদি তারা তোমাদের সন্তানদের দুধ পান করায় তবে তাদের পারিশ্রমিক দাও।” এই কাঠামো (আবাসন + ব্যয়ভার + মাতৃত্ব-সংক্রান্ত পারিশ্রমিক) তালাক-পরবর্তী অর্থনৈতিক নিরাপত্তার একটি প্রাথমিক রূপরেখা উপস্থাপন করে। তবে যুক্তি ও ন্যায়ের দৃষ্টিতে বিশ্লেষণ করলে স্পষ্ট হয় যে, এই নির্দেশগুলো মূলত স্বামীর ইচ্ছা ও সামর্থ্যের উপর নির্ভরশীল দয়া বা অনুগ্রহের ধরন ধারণ করে—যা নারীর স্বাধীন অধিকারের পরিবর্তে তার আত্মমর্যাদাকে ক্ষুণ্ণ করার জন্য যথেষ্ট।

আরেকটি গুরুত্বপূর্ণ আয়াত (২:২৪১) তালাকপ্রাপ্ত নারীদের জন্য “মাতাআ” বা “যুক্তিসংগত ব্যবস্থা” (reasonable provision)-এর ধারণা প্রবর্তন করে। এই ব্যবস্থা কি শুধু ইদ্দতকালীন তিন মাসের ভরণপোষণে সীমাবদ্ধ, নাকি তার বাইরেও প্রসারিত—এ নিয়ে ব্যাখ্যাগত বিতর্ক রয়েছে। কিন্তু ফাতিমাহ বিনতে কায়স-সংক্রান্ত সহিহ হাদিসগুলোর (সহিহ বুখারী ৫৩২৩-৫৩২৪; সহিহ মুসলিম ৩৬০০) সাথে সমন্বয় করলে দেখা যায় যে, অপরিবর্তনীয় তালাকের ক্ষেত্রে তালাকপ্রাপ্ত নারীর জন্য কোনো স্থায়ী বা অতিরিক্ত ভরণপোষণের অধিকার অবশিষ্ট থাকে না।


হাদিসঃ ফাতিমাহ বিনতে কায়সের বর্ণনা এবং ‘আয়িশাহর আপত্তি

ফাতিমাহ বিনতে কায়সের ঘটনাকে কেন্দ্র করে অপরিবর্তনীয় তালাক–প্রাপ্তা নারীর “বাসস্থান ও খোরপোষ নেই”—এমন বক্তব্য সহিহ সূত্রে বর্ণিত হয়েছে। এই বর্ণনাই বহু ফিকহি আলোচনায় একটি প্রধান ভিত্তি। একই সাথে –তে ‘আয়িশাহ (রাঃ)–এর মন্তব্য আসে: তিনি ফাতিমাহকে ভর্ৎসনা করেন এই বক্তব্যের জন্য যে “তালাকপ্রাপ্তা নারী বাসস্থান ও খোরপোষ পাবে না।” এমনকি, নবী নিজেও যখন তার সকল স্ত্রীদের তালাক দেয়ার ব্যাপারে ইচ্ছা প্রকাশ করেছিলেন, সেই সময়ে কাউকেই কোন ভরনপোষণ দেবেন না বলেই মনস্থির করেছিলেন, যা একটু পরে আলোচিত হবে। (( সহীহ বুখারী, তাওহীদ পাবলিকেশন্স, হাদিসঃ ৫৩২৩-৫৩২৪ )) (( সহীহ মুসলিম, হাদীস একাডেমী, হাদিসঃ ৩৬০০ ))

নবী মুহাম্মদের জীবন থেকে এটিও পরিষ্কারভাবে জানা যায় যে, নবী একবার সকল স্ত্রীদের তালাক দেয়ার ব্যাপারে সিদ্ধান্ত নেয়ার পরে, আয়িশা খোরপোষ চাওয়ায় আয়িশাকে তার পিতা আবু বকর নবীর সামনেই মারধোর করে, এবং এই দৃশ্য দেখে নবী মুহাম্মদ হেসে ওঠেন। অর্থাৎ সেই মারপিটকে সমর্থন দেন। (( সহীহ মুসলিম, ইসলামিক ফাউন্ডেশন, হাদিসঃ ৩৫৫৭ ))

৩৫৫৭। যুহায়র ইবনু হারব (রহঃ) ... জাবির ইবনু আবদুল্লাহ (রাঃ) থেকে বর্ণিত। তিনি বলেন, আবূ বকর (রাঃ) এসে রাসুলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম এর নিকটে উপস্থিতির অনুমতি প্রার্থনা করলেন। তিনি তার দরজায় অনেক লোককে উপবিষ্ট দেখতে পেলেন। তবে তাদের কাউকে ভেতরে প্রবেশের অনুমতি দেওয়া হয় নি। তিনি (বর্ণনাকারী) বলেন, এরপর তিনি আবূ বকর (রাঃ) কে প্রবেশের অনুমতি দেওয়া হলে তিনি প্রবেশ করলেন। এরপর উমর (রাঃ) এলেন এবং তিনি অনুমতি প্রার্থনা করলেন। তখন তাকেও প্রবেশের অনুমতি প্রদান করা হল। তিনি নবী সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম কে চিন্তিত ও নীরব বসে থাকতে দেখলেন আর তখন তার চতুষ্পার্শ্বে তাঁর সহধর্মিনীগণ উপবিষ্টা ছিলেন।
তিনি (বর্ণানাকারী জাবির ইবনু আবদুল্লাহ (রাঃ)) বলেন, উমর (রাঃ) বললেনঃ নিশ্চয়ই আমি নবী সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম এর নিকটে এমন কথা বলব যা তাঁকে হাসাবে। এপরতিনি বললেন, ইয়া রাসুলাল্লাহ! আপনি যদি দেখতেন খারিজার কন্যা (উমর (রাঃ) এর স্ত্রী) আমার কাছে খোরপোষ তলব করছিল। আমি তার দিকে উঠে গেলাম এবং তার ঘাড়ে ঘুষি মারলাম।তখন রাসুলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম হেসে উঠলেন এবং বললেন, আমার চতুষ্পার্শ্বে তোমরা যাদের দেখতে পাচ্ছ তারা আমার কাছে খোরপোষ দাবী করছে।
অমনি আবূ বকর (রাঃ) আয়িশা (রাঃ) এর দিকে ছুটলেন এবং তাঁর গর্দানে ঘুষি মারলেন। উমর (রাঃ)ও দাঁড়িয়ে গেলেন এবং হাফসা (রাঃ) এর দিকে অগ্রসর হয়ে তাঁর ঘাড়ে ঘুষি মারলেন। তাঁরা উভয়ে বললেন, তোমরা রাসুলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম এর নিকট এমন জিনিস দাবী করছে যা তাঁর কাছে নেই। তখন তাঁরা (নবী সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম এর সহধর্মিনীগণ) বললেন, আল্লাহর কসম! আমরা আর কখনো রাসুলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম এর কাছে এমন জিনিস চাইব না যা তাঁর কাছে নেই।
এরপরতিনি তাঁদের (তাঁর সহধর্মিনীগণের) থেকে একমাস কিংবা ঊনত্রিশ দিন পৃথক রইলেন। এপর তাঁর প্রতি এই আয়াত নাযিল হলঃ (অর্থ) "হে নবী! আপনি আপনার সহধর্মিনীদের বলে দিন, তোমরা যদি পার্থিব জীবনের ভোগ ও এর বিলাসিতা কামনা কর, তাহলে এসো আমি তোমাদের ভোগ-বিলাসে ব্যবস্থা করে দেই এবং সৌজন্যের সাথে তোমাদের বিদায় করে দেই। আর যদি তোমরা আল্লাহ, তাঁর রাসুল ও পরকালকে কামনা কর তাহলে তোমাদের মধ্যে যারা সৎকর্মপরায়ন আল্লাহ তাদের জন্য মহা প্রতিদান প্রস্তুত করে রেখেছেন।" (আহযাবঃ ২৮ ২৯)
তিনি [জাবির (রা)] বলেন, তিনি (রাসুলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম) আয়িশা (রাঃ) কে দিয়ে (আয়াতের নির্দেশ তামীল করতে) শুরু করলেন। তখন তিনি বললেন, হে আয়িশা! আমি তোমার কাছে একটি (গুরত্বপূর্ণ) বিষয়ে আলাপ করতে চাই। তবে সে বিষয়ে তোমার পিতা-মাতার সঙ্গে পরামর্শ না করে তোমার ত্বরিত সিদ্ধান্ত গ্রহণ না করাই আমি পছন্দ করি।
তিনি বললেন, ইয়া রাসুলাল্লাহ! সে বিষয়টা কি (আমি জানতে পারি)? তখন তিনি তার কাছে এই আয়াত তিলাওয়াত করলেন। তিনি বললেন, ইয়া রাসুলাল্লাহ! আপনার ব্যাপারে আমি কি আমার পিতা-মাতার কাছে পরামর্শ নিতে যাব? (এর কোন প্রয়োজন নেই)। না, বরং আমি আল্লাহ, তাঁর রাসুল ও আখিরাতকেই বেছে নিয়েছি। তবে আপনার সকাশে আমার একান্ত নিবেদন, আমি যা বলেছি সে সম্পর্কে আপনি আপনার অন্যান্য সহধর্মিনীগণের কারো কাছে ব্যক্ত করবেন না। তিনি বললেন, তাদের যে কেউ সে বিষয় আমাকে জিজ্ঞাসা করলে আমি অবশ্যই তাঁকে তা বলে দিব। কারণ আল্লাহ আমাকে কঠোরতা আরোপকারী ও হঠকারীরূপে নয় বরং সহজ পন্থায় (শিক্ষাদানকারী) হিসাবে প্রেরণ করেছেন।

ফিকহঃ বায়িন তালাকপ্রাপ্তা স্ত্রী খোরপোষ পায় না

ক্লাসিক্যাল ফিকহের প্রভাবশালী ধারায় (বিশেষ করে শাফিঈ, মালিকি এবং হাম্বলি মাযহাবে) ইররেভোকেবল তালাকের (যেমন তিন তালাক বা বায়িন) ক্ষেত্রে তালাকপ্রাপ্ত নারীর জন্য খোরপোষের অধিকার সম্পূর্ণ নাকচ করা হয়—এই মতটি ফাতিমাহ বিনতে কায়সের হাদিসের (( Maintenance after Divorce in Islam )) উপর ভিত্তি করে গৃহীত। কিছু বর্ণনায় মধ্যবর্তী অবস্থানও দেখা যায়, যেখানে অন্তত ইদ্দতকালীন আবাসনের অধিকার স্বীকৃত, কিন্তু খোরপোষ নয়—যদিও এটি সংখ্যালঘু মত।

অন্যদিকে, হানাফি মাযহাবের একটি ধারা কোরআনের ৬৫:৬ আয়াতকে প্রাধান্য দিয়ে যুক্তি দেয় যে, ইদ্দতকালীন বাসস্থানের স্পষ্ট নির্দেশ থাকায় এবং জীবনধারণের মৌলিক প্রয়োজনীয়তা বাসস্থানের সাথে অঙ্গাঙ্গীভাবে জড়িত থাকায়—ইদ্দতকালে খোরপোষও প্রাপ্য, এমনকি ইররেভোকেবল তালাকের ক্ষেত্রেও। এই মতে ফাতিমাহ বিনতে কায়সের বর্ণনাকে একক (আহাদ) হাদিস হিসেবে বিবেচনা করে কোরআনের সাধারণ নির্দেশকে অগ্রাধিকার দেওয়া উচিত বলে মনে করা হয় (( Husband providing for wife during iddah )) । তবে বাস্তব জগতে এই ধারাটি সংখ্যালঘু এবং দালিলিকভাবে শক্তিশালী নয়।

ফলাফল: ফিকহি ঐতিহ্যে “তালাকপ্রাপ্তা নারীর জন্য শূন্য-সহায়তা” (ইদ্দত-পরবর্তী কোনো বাধ্যতামূলক দায় ছাড়া)—এই কঠোর অবস্থানটি ব্যাপকভাবে প্রতিষ্ঠিত, যা প্রায়শই দরিদ্র ও অসহায় নারীদের উপর অর্থনৈতিক সংকট চাপিয়ে দেয়। কিছু ঐতিহাসিক ব্যাখ্যায় এই নারীদের জন্য ওয়াকফ বা দাতব্য তহবিল থেকে স্বেচ্ছাচারিত দয়াদাক্ষিণ্যের কথা উল্লেখ আছে, যা মূলত বাধ্যতামূলক অধিকার নয় বরং অনুগ্রহের উপর নির্ভরশীল।


গৃহস্থালি শ্রমের অবমূল্যায়ন: অর্থনৈতিক বাস্তবতা বনাম বিধান-রীতি

আধুনিক অর্থনৈতিক বিশ্লেষণে unpaid domestic and care work—রান্না, ঘর পরিচর্যা, সন্তান লালন-পালন এবং মানসিক শ্রম—কে স্পষ্টভাবে উৎপাদনশীল শ্রম হিসেবে স্বীকৃতি দেওয়া হয়, যদিও এটি বাজারে মজুরি হিসেবে গণনা হয় না। ILO-এর হিসাব অনুযায়ী, এই অবৈতনিক শ্রমের মূল্য বিশ্ব GDP-এর 9% বা প্রায় ১১ ট্রিলিয়ন ডলারের সমান, যার মধ্যে নারীদের অবদান ৬.৬% (ILO, 2018; UN Women, 2025)। কিছু দেশে এটি GDP-এর ৪০%-এর বেশি হতে পারে। ইররেভোকেবল তালাকের ক্ষেত্রে ইদ্দতকাল পর্যন্ত (বা কিছু ব্যাখ্যায় সেটিও না) সীমিত খোরপোষ-আবাসন দিয়ে সম্পর্ক ছিন্ন করা মানে দীর্ঘ বছরের এই শ্রম-অবদানকে সম্পূর্ণ “শূন্যমূল্য” ধরে নেওয়া। প্রথাগত ফিকহি যুক্তি এটিকে “বিবাহ একটি চুক্তি—শেষ হলে দায় শেষ” হিসেবে উপস্থাপন করে, কিন্তু নৈতিক ও অর্থনৈতিক দৃষ্টিকোণ থেকে এটি অসমতুল: সম্পর্ক থেকে উদ্ভূত নির্ভরশীলতা ও অবদানের বোঝা কেন শুধু দুর্বল পক্ষের (সাধারণত নারীর) কাঁধে চাপবে?

আরেকটি বাস্তব সমস্যা হলো, গৃহস্থালি শ্রমের কারণে অনেক নারী শিক্ষা বা কর্মজীবনের ধারাবাহিকতা হারান, ফলে তালাক-পরবর্তী তাৎক্ষণিক স্বনির্ভরতার প্রত্যাশা প্রায়শই অবাস্তব (NIH study, 2025)। এই প্রেক্ষিতে “খোরপোষ নেই/বাসস্থান নেই”—এই ইসলামিক আইন বাস্তবে নারীর জন্য গৃহহীনতা, দারিদ্র্য এবং সামাজিক ঝুঁকি বাড়ায়—যা কোরআনের ন্যূনতম নিরাপত্তা-নির্দেশ (ইদ্দতকালীন বাসস্থানে জুলুম না করা, গর্ভাবস্থায় ব্যয়ভার, দুধপানের পারিশ্রমিক) এর সাথেও সরাসরি সংঘর্ষ সৃষ্টি করে, কারণ এগুলো অত্যন্ত সীমিত এবং প্রায়শই অপর্যাপ্ত।


প্রাতিষ্ঠানিক বৈষম্য ও “সেফটি নেট” প্রশ্ন

At the very beginning of Surah at-Talaq (65) of the Quran there is a clear instruction (65:1): during the iddah period after divorce, women are "not to be turned out of their houses", and they too should not leave of their own accord. This instruction at least recognizes in principle the right to lodging during the iddah period. Verse 6 of the same surah (65:6) further states: "Provide them lodging according to your means... if they are pregnant, bear their expenses until they give birth... and if they nurse your children, give them their payment." Centering on the incident of Fatimah bint Qays, the statement that a woman given irrevocable divorce has "no residence and no maintenance" has been narrated through authentic chains. This narration serves as a principal foundation in many fiqh discussions. At the same time comes the comment of 'Aishah (RA): she rebuked Fatimah for this statement that "a divorced woman will not receive residence or maintenance." Indeed, when the Prophet himself expressed his intention to divorce all his wives, he had resolved not to give any of them maintenance — which will be discussed a little later. Fiqh: A Wife Given Ba'in Divorce Receives No Maintenance

In the dominant stream of classical fiqh (especially the Shafi'i, Maliki and Hanbali schools), the right to maintenance for a woman given irrevocable divorce (such as triple talaq or ba'in) is completely denied — an opinion adopted on the basis of the hadith of Fatimah bint Qays (( Maintenance after Divorce in Islam )). In modern economic analysis, unpaid domestic and care work — cooking, housekeeping, child-rearing and mental labor — is clearly recognized as productive labor, although it is not counted as a wage in the market. In some countries it can exceed 40% of GDP. In the case of irrevocable divorce, severing the relationship with maintenance and lodging limited to the iddah period (or, in some interpretations, not even that) means treating years of this labor contribution as entirely "zero-value". Rather, it is determined by real criteria such as the woman's economic incapacity, the time needed for rehabilitation, the length of the marriage, and the husband's means. For example, in the 2024 ruling of the Supreme Court of India in Mohd. Abdul Samad v. State of Telangana (2024 INSC 426), it was clearly held that a divorced Muslim woman can also claim long-term maintenance under Section 125 of the CrPC, and no interpretation of the Muslim Women (Protection of Rights on Divorce) Act of 1986 can entirely nullify this secular right.

This kind of comparative legal reasoning establishes a fundamental principled decision: the purpose of post-divorce support is not merely to complete the iddah or to ascertain pregnancy, but to ensure the realistic rehabilitation of the woman by preventing economic collapse. Whether it is consistent with religious interpretation is a separate question; but by the standards of justice and social stability, this rehabilitation-based model has proven tested and effective.


Quran-Hadith: Possible Interpretive "Rescues" and Their Limits

Some interpreters try to present the statement of "no lodging and no maintenance" in the hadith of Fatimah bint Qays as an incidental exception or context-dependent, so that the general instructions of the Quran (iddah lodging, not causing harm, bearing expenses during pregnancy) remain intact. Another strand confines the Quranic verses to only revocable divorce or the iddah condition, thereby maintaining the harsh position of "zero obligation" in irrevocable divorce.

The problem is that the second approach requires interpreting the Quran's explicit language on lodging (65:1, 65:6) and the concept of "mat'a" or reasonable provision in 2:241 in an extremely narrow and artificial way. An even bigger problem is that the Prophet Muhammad himself, when he had resolved to divorce his wives, remained firm in his principled decision not to give maintenance. It thus becomes clear that "no lodging + no maintenance" is in fact the most accepted opinion of Islamic Sharia, which directly undermines women's rights.


Conclusion

The traditional fiqh stream built around the hadiths of Fatimah bint Qays and the Prophet — which completely denies residence and maintenance to a woman given irrevocable divorce — creates three serious problems: (a) an interpretive conflict with the Quran's clear instructions on lodging and the concept of "mat'a", (b) reducing the real economic value of domestic labor to zero, and (c) unilaterally loading post-divorce economic and social risk onto women, increasing their insecurity.

Analyzed from the standpoint of reason and justice, it becomes clear that post-divorce financial support should be considered not merely "charity" or discretionary favor, but as the logical consequence of the dependency created during marriage, the woman's contribution, and basic human security. Where traditional interpretation leaves the woman with zero protection, modern legal precedents (such as the 2024 Mohd. Abdul Samad ruling of the Supreme Court of India) prove that state frameworks can recognize rehabilitation-based long-term support as legitimate and necessary, going beyond the limits of the iddah.
